Month-to-month, beginning on the date services go live. Cancel with 30 days written notice to info@dialbridge.ai. If Client cancels before configuration work begins, all fees including the onboarding fee will be refunded. No refunds for partial months. If Client fails to complete onboarding within 30 days of signing, Provider may close the account and the onboarding fee remains non-refundable.
6. Performance Guarantee
If the Service does not book at least 10 appointments within 60 days of the date services go live ("Go-Live Date"), Client is entitled to a refund of monthly service fees paid, subject to the following: (a) the 60-day period begins on the Go-Live Date; (b) a "booked appointment" means any appointment the Service schedules on Client's calendar, regardless of whether the caller is a new or returning customer, or whether the appointment is later cancelled, rescheduled, or missed; (c) Client must remain an active subscriber in good standing for the full 60-day period, with call forwarding to the Service enabled, to qualify; (d) the guarantee is void if Client pauses, disables, or materially restricts the Service during the period; (e) refund requests must be submitted in writing to info@dialbridge.ai within 14 days after the 60-day period ends; (f) the onboarding fee remains non-refundable per Section 3.
7. Pricing Changes
Provider may modify pricing with 30 days written notice. Continued use after the notice period constitutes acceptance.
8. Call Recording & AI Disclosure
Calls handled by the Service may be recorded and transcribed. Client is responsible for ensuring compliance with applicable call recording and consent laws in its jurisdiction, including any required disclosure to callers that they are interacting with an AI system.
9. AI Accuracy
The Service uses artificial intelligence and may occasionally mishear, misroute, or inaccurately record information. Provider does not guarantee the accuracy or completeness of any call handling, message, or booking. Client is responsible for reviewing messages and confirming appointments.
10. Data
Client owns its call recordings, transcripts, and caller information. Call data is retained for approximately 30 days (or as configured) and deleted thereafter. Upon cancellation, Client may request an export of available data within 30 days, after which it will be deleted. Provider may use aggregated, de-identified data to improve the Service.
11. Acceptable Use
Client will not use the Service for unlawful purposes and is responsible for the accuracy of all business information, scripts, and instructions provided to configure the Service. Client will indemnify Provider against claims arising from Client-provided content.
12. Confidentiality
Both parties agree to keep proprietary information shared during this Agreement confidential.
13. Liability
Provider's liability is limited to fees paid in the prior 30 days. Provider is not liable for indirect damages, missed calls, or service interruptions caused by third-party carriers or platforms.
14. Governing Law
Laws of the State of New Jersey. This Agreement supersedes all prior agreements.
